I. CANOE KAYAK TEACHING AND SUPERVISION SERVICES

Registration for supervised services provided by SAS ALOKANOE implies the pure and simple acceptance of the present general conditions by the subscriber, who undertakes to inform each participant of all the terms and conditions.

 

ART. 1 - PARTICIPANTS

SAS ALOKANOE offers, on behalf of independent instructors, the supervision and/or teaching of outdoor sports: kayaking and canoeing. All the proposed activities are supervised and provided by guides who hold at least a Professional Qualification Certificate (C.Q.P.) in their respective disciplines and who meet their legislative obligations (U.R.S.S.A.F., R.C.P., declaration D.D.C.S.P.P., professional cards).

 

ART. 2 - REGISTRATION AND BOOKING

All our activities are by reservation. There are several ways of doing this: by filling in the online booking form (www.alokanoe.fr) or by contacting ALOKANOE directly by e-mail (alokanoe@gmail.com) or by telephone (06.49.21.85.87).

 

GROUP OUTINGS: Registration is effective from the moment the subscriber receives a message by email or S.M.S. confirming the reservation for the chosen outing.

 

PRIVATE OUTINGS (institutions, companies, associations): The registration is effective upon receipt of the deposit corresponding to 30% of the total amount of the service and an email confirming the reservation for the chosen outing.

 

In both cases, the balance will be paid directly to the professional in his or her own name, at the beginning of the activity.

 

ART. 3 - PRICES

ALOKANOE's prices are presented on the website and on the day of the outing.

 

The prices include: the organisation, the supervision provided by a certified or state-qualified guide and the loan of the equipment necessary for the chosen activity (boat, paddle, canister).

 

In all cases, we invite you to refer to the product data sheet, available on our website or on request.

 

Prices do not include: the possible rental of equipment (e.g. Go Pro p), transport to the activity location (meeting point and practice site) and personal expenses.

 

For day trips, meals (picnic, water, snacks) are at the client's expense, unless otherwise stated.

 

For multi-day trips, additional costs such as overnight stays, meals and snacks are at the client's expense and must be paid directly to the host/restaurateur.

 

ART. 4 - METHOD OF PAYMENT

For supervision services, payment must be made directly to the instructor who is in charge of the session on the day of the session, in his own name or to the attention of ALOKANOE. This will be mentioned at the time of booking.

 

Means of payment accepted: cheque, holiday cheque, bank transfer, credit card (secure payment by internet) or cash.

 

ART. 5 - CONDITIONS OF PARTICIPATION

Our activities are open to all; nevertheless, depending on the activities and the courses, certain conditions must be taken into account (age limit, ability to swim, technical level, physical condition, etc.).

 

ALOKANOE does not have the means to check the level of sport practice of its clients.

 

It is therefore the responsibility of each participant to have assessed their physical condition according to the choice of course they wish to undertake. To find out about these conditions, please refer to the technical data sheets for the routes (available on our website www.alokanoe.fr).

 

For canoe and kayak activities, it is imperative to be able to swim 25m and immerse yourself. The minimum age required is 6 years.

 

You must not have any medical contraindication to the chosen activity.

 

IMPORTANT : If you are not medically contraindicated but you are dependent on special medical care or treatment (asthma, diabetes, etc.) or your health requires special attention (fragile joints, back problems, compulsory wearing of glasses, etc.), you must inform the instructor before the start of the activity and bring the appropriate emergency medication, according to medical recommendations.

 

ART. 6 - INSURANCE AND LIABILITY

 

Each instructor/professional is insured with Professional Civil Liability for his or her own activities and for the costs incurred by any rescue operation.

 

We strongly advise each participant to be covered by a civil liability insurance and/or an individual accident insurance with the insurance company of his/her choice for the practice of white water and/or mountain sports. Indeed, we cannot substitute ourselves to the individual civil liability of each participant.

 

SAS ALOKANOE is insured for civil liability for all the activities it offers and its responsibility cannot be engaged for activities booked with other providers.

 

In the event of a physical accident, the responsibility of SAS ALOKANOE and the instructor involved is released as soon as the victim is taken care of by the competent rescue organizations, and any hospital follow-up will be the responsibility of the personal insurance of the injured person.

 

The practice of outdoor activities takes place in a specific environment known as "at risk".

 

Each participant is aware, given the specific nature of the activities proposed, that he/she may run certain risks due in particular to the distance, isolation and specific nature of the environment (river, forest, etc.). He/she assumes these risks with full knowledge of the facts and must comply with the rules of caution and follow the advice given by the professionals.

 

The participant/client is responsible for the equipment lent to him/her for the activity. The professional cannot be held responsible for any damage caused by the equipment provided.

 

In the event of theft or damage to the equipment loaned, the participant/customer may be asked to pay compensation for wear and tear or a full refund of the equipment.

 

The professionals (instructors) and SAS ALOKANOE cannot be held responsible for the loss, theft (including in vehicles) or breakage of objects (e.g. glasses, cameras, etc.) that the participants may take with them during the activity and which may occur during the activity.

 

ART. 7 - CANCELLATION / INTERRUPTION BY THE CLIENT

 

7.1 Cancellation by the client

 

- Cancellation of a booking at least 10 days before the day of descent: full refund of the deposit, however a deduction of 5 € will be made if the deposit was paid online by credit card and is less than 250 €, and 10 € for any deposit over 250 € paid by credit card online. 

 

- Cancellation of a reservation between 9 and 2 days before the rental period: the deposit is retained

 

- Cancellation of a reservation less than 48 hours before the event: the balance will be required

 

In case of force majeure and upon presentation of a proof, ALOKANOE can reimburse the amount paid, but will not be required by the customer. In any case, the customer agrees to notify ALOKANOE of any notifications relating to the reservation: organization of the program, change of staff, delay or cancellation.

 

7.2 - Interruption during the service

 

In the event of interruption during the service, the client or participant will not be entitled to any refund.

 

ART. 8 - CANCELLATION / EXCLUSION BY ALOKANOE

 

8.1 - Cancellation

 

The instructors of ALOKANOE reserve the right to cancel or adapt the outing according to the weather conditions or the level of the participants.

 

The activity can be cancelled for safety reasons (weather, floods ...) or for any other case of force majeure. In this case, a replacement activity will be organised as far as possible or another date will be proposed. If the outing cannot be carried out, the service will be refunded in full without any other compensation being due.

 

In the event of cancellation by us due to an insufficient number of participants (less than 4 people) and if no alternative date is available, the participants will be fully refunded and will not be entitled to any compensation.

 

8.2 - Exclusion

 

ALOKANOE instructors reserve the right to exclude a participant who is intoxicated or whose behaviour is likely to disturb the smooth running of the activity or to compromise the safety of the group. In this case, the client or participant will not be entitled to any refund or compensation.

 

ART. 9 - APPOINTMENT

 

A meeting time and place are systematically communicated to you whatever the service. For the smooth running of the activities and out of respect for the other participants and the professional who is supervising you, we ask you to take note of the roadmaps and other information previously sent to you by us. Please make sure that you plan your journeys in advance so as to be punctual. We tolerate a maximum delay of 15 minutes. After this time, the monitors will leave for their activities and no refund or compensation will be due.

 

ART. 10 - SUPERVISION OF YOUNG PEOPLE (MINORS):

 

Unaccompanied minors :

 

Minors under 14 years of age who are not accompanied by an adult (legal guardian) are not accepted in the so-called "collective" activities.

 

Unaccompanied minors between 14 and 18 years old can be accepted in the so-called "collective" activities, subject to parental authorisation and certain conditions (level of sport, ability, etc.).

 

In this case a parental authorisation must be signed by the legal representative on the day of the activity.

 

In the event that the activity requires a trip to the site (place of departure), the transport of the minor must be provided by the legal representative.

 

Minors in the framework of CVL / CLSH / School :

 

The organisation organising the stay or outing must be able to provide the instructor and SAS ALOKANOE with the following for each participant (young person and leader)

 

- a 25-metre swimming certificate and a certificate of ability to immerse,

 

- the health form for each participant.

 

On the other hand, ALOKANOE undertakes to provide the certificates and documents necessary for the organisation of the stay/outing (DDCSPP authorisation, insurance, supervisors' diplomas, etc.).

 

The number of participants per supervisor depends on the level of the participants, the conditions of the environment, the characteristics of the activity and the skills of the supervisor, without exceeding sixteen (maximum). Each group of minors must be accompanied by two adults, one of whom must be a counsellor from the centre and the instructor supervising the activity.

 

ART 11. GIFT VOUCHER

 

The gift voucher is effective upon receipt of the full amount of the service.

 

The order form is nominative. However, it can be transferred to the person of your choice on condition that you inform us in advance to modify the details of the new beneficiary.

 

The beneficiary of the gift voucher must contact us to book the outing.

 

The activity of the gift voucher is not replaceable, but it is possible to carry out an activity of a higher amount by paying the difference.

 

ATTENTION: The gift voucher has an expiry date. Once the validity period (current year) has expired, the service will be considered as completed and cannot be postponed. The beneficiary and/or the buyer cannot claim any reimbursement or compensation.

 

The gift voucher and the personal document must be presented to the instructor in charge of the session on the day of the outing.

 

The outing will be guaranteed if the minimum number of participants required is ensured and if the weather conditions allow the activity to take place.

 

ART. 12 - SETTLEMENT OF DISPUTES

 

The parties shall endeavour to resolve amicably any difficulties that may arise in the execution of the contract. If no amicable agreement can be reached, all disputes relating to the validity, interpretation and performance of this agreement will be governed exclusively by the rules of French law.

 

All disputes, of whatever nature, shall fall under the jurisdiction of the French civil and commercial courts, including those ruling in summary proceedings.

 

II. RENTAL OF EQUIPMENT

 

ART 1. BOOKING

 

All our activities, including equipment hire, are subject to reservation. For this, you have several solutions: by filling in the online booking form (www.alokanoe.fr) or by contacting ALOKANOE directly by email (alokanoe@gmail.com) or by telephone (06.26.45.60.78).

The reservation is effective from the moment the subscriber receives a message by e-mail or SMS confirming the reservation.

 

ART. 2 - PRICES

The rental prices are displayed on the website and on the rental site.

 

The prices include: the rental of technical equipment.

 

- The boat (canoe or kayak),

- The buoyancy waistcoat,

- The paddle,

- The waterproof canister.

 

Prices do not include: the possible rental of additional equipment (e.g. Go Pro p), transport to the activity site (meeting point and practice site) and personal expenses.

 

ART. 3 - METHOD OF PAYMENT

 

The payment must be sent (made out) to the order of ALOKANOE.

Means of payment accepted: cheque, holiday cheque, bank transfer, credit card or cash.

 

A deposit of 200€ is required for each piece of equipment rented and will be returned when the equipment is returned. The balance will be paid when the equipment is returned.

 

The opening hours are mentioned when the equipment is handed over. In case of late return (outside the opening hours) an extra charge of 20€ will be required and due.

 

ART 4. INSURANCE AND LIABILITY

 

In the case of sports activities with equipment, and especially in the case of sports equipment rental (excluding activities supervised by an instructor), the client acknowledges that he/she has sufficient knowledge and technical skills to carry out this sports activity alone. In this case, the client practices the activity for which the equipment is rented under his own responsibility and at his own risk. SAS ALOKANOE cannot be held responsible for any accident that may occur during the said activity.

 

The team and SAS ALOKANOE do not have the means to check the level of sporting practice of its clients, it is therefore up to each participant/client to have evaluated his physical form, his knowledge and his skills according to what he wishes to achieve.

 

ART. 5 - INSURANCE

 

SAS ALOKANOE is insured for Professional Civil Liability for its own activities and cannot be held responsible for any incident or accident that may occur during a non supervised activity.

 

Furthermore, we strongly advise each participant to be covered by a civil liability insurance and/or an individual accident insurance with the insurance company of his/her choice for the practice of mountain sports.

 

The practice of outdoor activities takes place in a specific environment known as "at risk".

 

Each participant is aware, given the specific nature of the activities practised, that he/she may run certain risks due to the remoteness, isolation and specific nature of the activity and the environment (river, cave, etc.). He/she assumes these risks with full knowledge of the facts and must comply with the rules of caution and follow the recommendations of the delegated federations (FFME) and the competent authorities (DDCSPP, municipality and prefecture).

 

The participant/client is responsible for the equipment allocated to him/her. SAS ALOKANOE cannot be held responsible for any damage that may be caused by this equipment. In the event of theft, loss or damage to the equipment rented, the participant/customer will be asked to pay compensation for wear and tear or a full refund of the equipment.

 

SAS ALOKANOE cannot be held responsible for the loss, theft (including in vehicles) or breakage of objects (e.g. glasses, cameras...) that the participants could take with them during the activity and that could occur during the activity.

 

ART. 6 - CANCELLATION / INTERRUPTION BY THE CLIENT

 

6.1 Cancellation by the client

 

In the event that the client has paid a deposit, the following are the refund clauses:

 

- Cancellation of a booking more than 10 days in advance: full refund of the deposit, however a deduction of 5 € will be made if the deposit was paid online by credit card and is less than 250 €, and 10 € for any deposit over 250 € paid by credit card online.  

 

- Cancellation of a reservation within 5 days: the deposit is retained 

 

- Cancellation of a reservation within 2 days: the balance will be required

 

In case of force majeure and under presentation of a proof, ALOKANOE can refund the amount paid, but will not be required by the customer.

 

In any case, the client agrees to notify ALOKANOE of all notifications relating to the booking: organisation of the programme, change of staff, delay or cancellation.

 

6.2 Cancellation by ALOKANOE

 

SAS ALOKANOE reserves the right to cancel an activity for safety reasons (weather, course maintenance, floods ...) or for any other case of force majeure. In this case and as far as possible, another date/slot will be proposed to the client. If the outing cannot be carried out, the amount paid will be refunded in full without any other compensation being due.

 

6.3 Exclusion / refusal of equipment rental

 

SAS ALOKANOE reserves the right to refuse the rental of equipment to a participant whose level of competence does not allow him/her to practice the activity alone in safety or whose behaviour is likely to compromise his/her own safety and that of the group accompanying him/her. In this case, the client or participant will not be entitled to any refund or compensation.

 

ART. 7 - YOUTH (MINORS):

 

Unaccompanied minors: Minors under 18 years of age who are not accompanied by an adult (legal guardian) are not entitled to hire technical equipment.

 

ART. 8 - SETTLEMENT OF DISPUTES

 

The parties shall endeavour to resolve amicably any difficulties that may arise in the execution of the contract. If no amicable agreement can be reached, all disputes relating to the validity, interpretation and performance of this agreement shall be governed exclusively by the rules of French law.

 

All disputes, of whatever nature, shall fall under the jurisdiction of the French civil and commercial courts, including those ruling in summary proceedings.
